Terms of Service
The German Archaeological Institut, Eurasia-Department is abbreviated in the following as Eurasia-Department.
1. "Authorized Users" means:
- 1.1 individuals who are affiliated with an institution, as defined below and need access to CHARDA-Xplore for research purposes. This includes:
- 1.1.1 for educational non-profit (such as colleges, universities): currently enrolled students (when they are involved in a research project or writing their thesis), affiliated and visiting researchers, full- and part-time staff;
1.1.2 members of scholarly organisations;
1.1.3 other users agreed upon in writing by the Eurasia-Department.
2. Use of CHARDA-Xplore
- 2.1 Permitted Uses
Institutional Licensees and/or Authorized Users may search, view, reproduce, display, download, print, perform, and distribute content in CHARDA-Xplore provided they abide by the restrictions in Sections 2.2 and elsewhere in these Terms and Conditions of Use, for the following permitted Uses:
- 2.1.2 research activities;
2.1.3 classroom instruction and related classroom activities;
2.1.4 student assignments;
2.1.5 as part of a scholarly, cultural, educational presentation or workshop, if such use conforms to the customary and usual practice in the field;
2.1.6 on an ad hoc basis and without commercial gain, sharing discrete textual content or specimens with an individual who is not an Authorized User for purposes of collaboration, comment, or the scholarly exchange of ideas;
2.1.7 in research papers or dissertations, including reproductions of the dissertations if the Eurasia Department is asked for permission;
2.1.8 linking (see Section 3., below).
- 2.2 Prohibited Uses
Institutions and users may not:
- 2.2.1 use or authorize the use of CHARDA-Xplore for commercial purposes or gains;
2.2.2 except as set forth in Section 2.1.7, provide and/or authorize access to the CHARDA-Xplore or content available through individual access to persons or entities other than Authorized Users;
2.2.3 modify, obscure, or remove any copyright notice or other attribution included in CHARDA-Xplore or its data;
2.2.4 attempt to override, circumvent, or disable any encryption features or software protections employed in CHARDA-Xplore;
2.2.5 undertake any activity that may burden CHARDA-Xplore's server(s) such as computer programs that automatically download or export content, commonly known as web robots, spiders, crawlers, wanderers or accelerators;
2.2.6 make any use, display, performance, reproduction, or distribution that exceeds or violates these Terms and Conditions of Use;
2.2.7 incorporate content into an unrestricted database or website, except that authors or other content creators may incorporate their content into such sites with prior permission from the publisher and other applicable rights holders.
It is not allowed to link to CHARDA-Xplore from other sites or databases or the connected domain, exept the Eurasia-Department is asked for permission.
4. Intellectual Property Rights
- 4.1 General Intellectual Property Rights
CHARDA-Xplore and any trademarks, issued patents and patent applications, copyrights and copyright registrations and applications, rights in ideas, designs, works of authorship, derivative works, and all other intellectual property rights (collectively, "Intellectual Property") relating to CHARDA-Xplore are proprietary to the Eurasia-Department, subject to the rights of third parties. Authorized Users use of CHARDA-Xplore implies no rights to Intellectual Property except for the limited rights set forth in these Terms and Condition of Use.4.2 Use of Software
The Eurasia-Department utilizes software and other electronic tools designed to permit Authorized Users to access, use, reproduce, display, and distribute content ("Access Software") of CHARDA-Xplore. Use of the Access Software and its related documentation is limited to the license granted herein. Users may not copy, distribute, modify, decompile, reverse engineer, circumvent, override or disable encryptions or other protections in, or create derivative works from the Access Software.
5. Responsibilities of Authorized Users
Authorized Users are responsible for maintaining the confidentiality and security of their username and/or password, and for all usage or activity that is made through this data inside of CHARDA-Xplore. Except as permitted in Section 2.1(e), Authorized Users may not provide access to CHARDA-Xplore to anyone else.
Authorized Users promptly shall notify the Eurasia-Department of any known or suspected unauthorized use(s) of their account or CHARDA-Xplore, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure or use of their username and password. Any use of CHARDA-Xplore beyond the scope or in violation of these Terms and Conditions of Use, knowing use of any username and password of another, or any fraudulent, abusive, or otherwise illegal activity, may be grounds for termination of an Authorized User's account.
6. Warranty and Disclaimers
The Eurasia-Department represents and warrants that use of CHARDA-Xplore by Authorized Users in accordance with the terms of this Agreement shall not infringe the copyright of any third party. The foregoing shall not apply, however, to modifications or derivative works of CHARDA-Xplore created by Authorized Users or by any third party, nor usage of CHARDA-Xplore by Authorized Users in violation of these Terms and Conditions of Use.
The Eurasia-Department shall not be liable, and Authorized Users agree that they shall not hold the Eurasia-Department liable for any loss, injury, claim, liability, damages, costs, and/or attorneys fees of any kind that result from an improper usage of CHARDA-Xplore.
